These Terms and Conditions ("Terms") govern your use of our website, gallery space, and services, including the purchase of artwork. By accessing our gallery, browsing our website, or purchasing artwork from us, you agree to be bound by these Terms.

ARTIST TERMS & AGREEMENT
About the Gallery
The Brisbane Gallery is a contemporary art and design space in Taringa dedicated to showcasing the creative work of Brisbane and Australian artists.

Our focus is on high-quality craftsmanship, originality, and refined presentation within a design led environment. We aim to support artists by providing a welcoming, professional space that encourages connection between artists, collectors, and the broader community.
We believe exhibitions should be thoughtfully curated, professionally presented, and mutually beneficial for both artists and the gallery. Our role is to provide a platform that supports artists while creating meaningful opportunities for engagement, exposure, and sales.

Eligibility & Artistic Integrity

To exhibit with The Brisbane Gallery, artists must:

• Be 18 years or older.

• Be the sole creator of all works submitted.

• Submit only original artwork.

• Ensure no works are AI-generated or derivative of another artist's work.

• Hold all rights necessary to exhibit and sell the submitted work.

• By submitting work, the artist confirms they hold full rights to exhibit and sell each piece.

Our Approach

 

• Exhibitions at The Brisbane Gallery are intentionally curated and thoughtfully presented. We prioritise clean, balanced visual design, ensuring every artwork is displayed with space and consideration.

• Our programming includes exhibitions, opening events, artist features, workshops, and community engagement opportunities designed to connect artists with collectors and the wider public.

Who We Represent

 

• The gallery works with Brisbane-based and Australian artists across a range of mediums including painting, sculpture, ceramics, photography, jewellery, design objects, and mixed media.

 

Selection is based on:

• A clear and distinctive artistic voice.

• Originality and innovation in concept and technique.

• High standards of craftsmanship.

• Visual alignment with the gallery aesthetic.

• Suitability within exhibition themes and scheduling.

• Acceptance into one exhibition does not guarantee acceptance into future exhibitions.

Artwork Delivery, Preparation & Presentation

Delivery & Collection

Artists agree to:

 

• Deliver artworks at the time arranged with the gallery.

• Collect artworks within the nominated collection period.

• Arrange any representatives or couriers (18 years or older) if they cannot attend in person.

• Communicate as early as possible if scheduling changes are required.

 

Presentation Standards
To ensure consistency and professionalism, artworks must be:

• Exhibition-ready on arrival.

• Clean, dry, and in excellent condition.

• Fitted with secure D-rings or professional hanging hardware for two-dimensional works.

• Stable, clean, and professionally finished for three-dimensional works.

• Labelled with the artist name, artwork title, medium, dimensions, and retail price.

 

The gallery reserves the right to:

• Decline works that do not meet presentation standards.

• Add or replace hanging hardware where required at the artist's cost.

• Refuse substituted artworks that have not been approved prior to delivery.

 

Insurance, Care & Liability
The Brisbane Gallery takes reasonable care when handling all artworks.
However:

• The gallery does not accept liability for loss, theft, accidental damage, or deterioration of artworks.

• Artists are responsible for arranging their own insurance, including transit, theft, damage, and exhibition cover.

• Ownership of artworks remains with the artist until a sale is completed and cleared funds have been received by The Brisbane Gallery.

• The artist indemnifies the gallery against disputes arising from ownership, copyright, authenticity, or third-party claims.

This ensures clarity and shared responsibility.

 

Copyright & Image Use

Artists retain full copyright to their work at all times.

By exhibiting with The Brisbane Gallery, the artist grants the gallery a royalty-free, non-exclusive licence to:

• Photograph and film artworks within the gallery.

• Reproduce supplied or captured images for promotional purposes.

• Use images in print, digital media, social media, catalogues, press releases, advertising, signage, and exhibition materials.

• Feature the artist's name, biography, website, and social media accounts when promoting their work.

• Images will always be used respectfully and solely for the purpose of promoting the artist, the exhibition, or The Brisbane Gallery.

 

Sales, Commission & Exclusivity

• The gallery retains a 30% commission on all artworks sold.

• All prices provided to The Brisbane Gallery must be the final retail sale price and must be inclusive of any applicable GST and the gallery's commission.

• Artists registered for GST are responsible for advising the gallery of their GST status and ensuring prices provided appropriately reflect their GST obligations.

• The Brisbane Gallery will pay artists within forty-eight (48) hours of receiving cleared funds from the purchaser.

• As payment providers may take several days to release funds, artist payments cannot be processed until sale proceeds have been received by the gallery.

• A sales summary will be provided with each payment.

 

Exhibition Exclusivity

To protect the integrity of the exhibition and the gallery's marketing investment:

• Accepted artworks must remain available for display and sale for the full exhibition period.

• Accepted artworks must not be offered for sale or sold through any other gallery, exhibition, website, online marketplace, social media platform, or private sales channel during the exhibition period without the prior written consent of The Brisbane Gallery.

• Accepted artworks form part of the curatorial selection and may not be withdrawn, removed, substituted, exchanged, altered, or replaced without the prior written consent of The Brisbane Gallery.

• If an accepted artwork becomes unavailable prior to or during the exhibition, the artist must notify the gallery immediately.

 

Post-Exhibition Marketing Period

• The Brisbane Gallery retains the right to continue marketing exhibited artworks for a period of fourteen (14) days following the official close of the exhibition.

• During this period, artworks may continue to be featured in catalogues, website listings, social media promotions, collector communications, and sales follow-up activities.

• Any sale resulting from the gallery's exhibition, marketing, collector introductions, or sales activities during this fourteen (14) day period remains subject to the gallery's standard commission.

• Upon expiry of the fourteen (14) day post-exhibition period, the gallery releases the artwork from any ongoing commission entitlement, except where an active sales negotiation or collector introduction commenced during the exhibition or post-exhibition marketing period.

Artwork Collection & Storage

• Artworks must be collected within the timeframe provided by The Brisbane Gallery.

• The gallery reserves the right to charge reasonable storage fees for artworks not collected within fourteen (14) days of the nominated collection date.

• The gallery cannot accept responsibility for artworks left beyond the collection period.

• Where artworks remain uncollected for more than three (3) months after the nominated collection date, and reasonable attempts have been made to contact the artist, The Brisbane Gallery reserves the right to dispose of, donate, sell, or otherwise deal with the artwork as it sees fit.

• This ensures smooth transitions between exhibitions and protects the gallery's limited storage capacity.

 

Professional Conduct

• The artist and The Brisbane Gallery agree to maintain respectful communication and uphold professional standards at all times.

• Neither party will engage in public statements, online or offline, that may intentionally damage the reputation of the other.

• Any concerns or disputes should first be raised directly between the parties in an effort to resolve matters professionally and in good faith.

 

Exhibition Changes & Cancellation

• The Brisbane Gallery reserves the right to postpone, reschedule, modify, or cancel an exhibition where circumstances reasonably require it, including venue issues, emergencies, illness, safety concerns, insufficient participation, or events beyond the gallery's reasonable control.

• The gallery will make reasonable efforts to notify artists as soon as practicable and work collaboratively to identify alternative arrangements where possible.

 

What The Gallery Provides

• A professionally curated exhibition environment.

• Thoughtful presentation of artworks.

• Promotion through the gallery website, social media, newsletters, media opportunities, and events.

• Sales management and prompt payment.

• Exhibition openings and opportunities for artist engagement.

• Guidance where requested on pricing, presentation, and exhibition preparation.

 

What We Ask of Artists
Artists agree to:
Return a signed agreement.
Provide a valid ABN or ATO Supplier Declaration Form.
Advise the gallery if they are registered for GST.
Deliver artworks in excellent, labelled, exhibition-ready condition.
Provide artist statements, biographies, and high-quality images when requested.

Promote the exhibition through their own networks where possible.
Comply with the exhibition exclusivity requirements outlined in this agreement.
