A legal disclaimer

These Terms and Conditions ("Terms") govern your use of our website, gallery space, and services, including the purchase of artwork. By accessing our gallery, browsing our website, or purchasing artwork from us, you agree to be bound by these Terms.

1. Definitions

  • "Gallery," "We," "Us," or "Our" refers to The Brisbane Gallery.

  • "Client," "You," or "Your" refers to the visitor, user, or purchaser of artwork.

  • "Artwork" refers to any paintings, sculptures, prints, digital art, or other creative pieces offered for sale or exhibition by the Gallery.

2. Artwork Purchases and Pricing

  • Pricing: All prices are listed in Australian Dollars (AUD) and are subject to change without notice. Prices are inclusive of Goods and Services Tax (GST) unless stated otherwise.

  • Availability: Artworks are unique or limited editions. Availability is on a first-come, first-served basis. A piece is not secured until full payment or a contractually agreed deposit is received.

  • Invoicing: Upon agreement of sale, an invoice will be issued. Payment must be settled within the timeframe specified on the invoice.

3. Payment Methods and Retention of Title

  • We accept payments via direct bank transfer, major credit cards, and approved art financing systems.

  • Retention of Title: Title and legal ownership of the Artwork remain strictly with The Brisbane Gallery or the representing Artist until full payment has cleared into our bank account. The Artwork will not be released for collection or delivery until full payment is verified.

4. Shipping, Delivery, and Collection

  • Collection: Clients may collect purchased Artwork from the gallery by appointment once payment is cleared.

  • Shipping: If delivery is requested, the Client is responsible for all shipping, packing, and transit insurance costs unless explicitly negotiated otherwise.

  • Risk of Loss: Risk of damage or loss passes to the Client immediately upon the Artwork leaving the Gallery premises (for collections) or upon transfer to the third-party courier/freight service (for deliveries).

5. Returns, Refunds, and Authenticity

  • All Sales Are Final: Due to the unique nature of fine art, all sales are final. We do not offer refunds, exchanges, or store credit for change of mind.

  • Condition Reports: Clients are encouraged to inspect Artworks in person or request a detailed condition report prior to purchase. Artworks are sold "as is."

  • Authenticity: The Gallery guarantees the authenticity of the Artworks sold, backed by a Certificate of Authenticity provided upon the completion of the sale.

6. Intellectual Property Rights

  • Copyright: The purchase of a physical or digital Artwork does not transfer copyright or reproduction rights to the Client. Copyright remains entirely with the Artist.

  • Restrictions: You may not replicate, commercially exploit, or create derivative works from the Artwork without express, written permission from the Artist and the Gallery.

  • Gallery Images: Images, text, and media displayed on our website or promotional materials are the property of The Brisbane Gallery and may not be used without authorization.

7. Gallery Etiquette and Liability

  • Visitors to our physical gallery space must exercise reasonable care. Large bags, umbrellas, and food or drink are prohibited near the Artworks.

  • Liability: To the maximum extent permitted by law, The Brisbane Gallery is not liable for any indirect, incidental, or consequential damages arising from the use of our services or the purchase of Artworks.

8. Governing Law

These Terms are governed by and construed in accordance with the laws of Queensland, Australia. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Queensland.

9. Amendments

We reserve the right to modify these Terms at any time. Any updates will be posted directly to our website and will take effect immediately upon posting.
